TERMS AND CONDITIONS
The following Terms and Conditions (“Terms”) govern the promotion (the “Promotion”) discussed in the SMS message, FashionNova app-push marketing, and FashionNova website banner sent and/or posted by Fashion Nova, LLC (“Fashion Nova”) to select U.S. customers on November 27, 2025 (the “Promotion Date”). Residents of Puerto Rico are not eligible. Employees of Fashion Nova, participating vendors (if any), their respective parent companies, affiliates, and subsidiaries, and their respective participating advertising, promotions, and public relations agencies, as well as members of their families and/or those living in the same household are not eligible to participate.You must have access to the Internet and a valid email address in order to participate. By participating in the Promotion, you accept and agree to be bound by these Terms, in addition to Fashion Nova’s Privacy Policy, available https://www.fashionnova.com/pages/privacy-policy and General Terms of Service, available https://www.fashionnova.com/pages/terms-of-service.
Order Refund: The first U.S. 1,000 customers who buy merchandise on FashionNova.com or the FashionNova app (the “Site”) on the Promotion Date (each, a “Recipient”), beginning at 8:00 am Pacific Time, will be issued a refund up to $100.00 of any merchandise purchased in their respective order. Gift cards are not eligible for refunds. Limit one refund per customer and/or account. Merchandise must be purchased for personal use and not for resale. Refunds will be processed within five (5) business days of their purchase confirmation, and will be credited back to the credit card/account from which the purchase was charged. If fewer than 1,000 customers submit orders on the Promotion Date, each customer will receive a refund. If more than 1,000 customers place orders on the Promotion Date, only the first 1,000 orders placed will receive refunds. Fashion Nova’s clock is the official clock, and the first 1,000 orders will be selected in the order they are received by Fashion Nova. If any of the products or content related to the Promotion are returned, your refund will equal the amount you actually paid for the product, subject to applicable refund policies. Except where prohibited by law, by accepting the Order Refund, Customer grants Fashion Nova the right to use Customer's name, likeness, voice, statements about the Promotion, city and state of residence, and any content created in connection with the Promotion, for trade, advertising, public relations and promotional purposes on Fashion Nova's Site and owned social media channels, without further compensation, unless prohibited by law. Customer agrees that Fashion Nova may contact Customer by phone or video regarding this Promotion. Customers understand that Fashion Nova may audio and/or video record any such calls or sessions and use those recordings for advertising and promotional purposes, to the extent permitted by law.
Fashion Nova reserves the right, in its sole discretion and without providing prior notice, to modify or terminate the Promotion. Qualifying purchases must be made for personal use and not for resale; Fashion Nova may disqualify and/or cancel orders placed by anyone who it believes is purchasing for resale. This is a first-come, first-served promotional offer. Order Refund will be issued in the order in which eligible participants complete qualifying purchases.
The Promotion is provided on an “as-is” basis without any representation or warranty of any kind. To the fullest extent permitted by law, Fashion Nova shall not be liable for any loss or damage whatsoever caused by matters relating to the Promotion including, but not limited to, financial, human, machine, or typographic error. Fashion Nova reserves the right, in its sole discretion, to disqualify customers from the Promotion if there is reasonable belief that there has been an attempt to obtain or generate any fraudulent or other non-permissible mechanisms to participate in the Promotion, or if any of the provisions of these Terms have been violated. The Promotion is and the agreed upon Terms set forth herein shall be governed by the laws of the State of California, excluding conflicts of laws principles.
